Terms of Service

1. Eligibility

You may use the Service only if you can form a binding contract under applicable law. The Service is not restricted to adults only, but if you are under the age of majority in your jurisdiction, you should use the Service with the involvement of a parent or legal guardian.

Driving Safety Disclaimer. Trip&Trail is not a driving assistance system and is not intended to be used while actively operating a vehicle.

The Service is designed solely for recording, reviewing, and analyzing driving-related data. It does not provide real-time driving guidance, navigation, safety alerts, or any form of assistance that should be relied upon while driving.

• You will not interact with the app while driving unless it is safe and lawful to do so.
• You are solely responsible for maintaining full attention to the road and complying with all applicable traffic laws.
• You will not rely on the Service for any driving-related decisions.

Catificial LLC is not responsible for any accidents, damages, or losses that may occur as a result of using the Service while driving.

Use of the Service is at your own risk.

2. The Service

Trip&Trail helps users connect Tesla accounts, view vehicle-related information, manage trips, send supported commands, and use related features made available through the Service.

We may modify, suspend, or discontinue any part of the Service at any time, with or without notice.

3. Account Registration and Security

To use certain features, you may need to create an account and provide accurate, complete, and current information.

You are responsible for maintaining the confidentiality of your login credentials, all activity that occurs under your account, and promptly notifying us at [email protected] if you believe your account has been compromised.

4. Tesla Account Connection

Some features require you to connect your Tesla account through Tesla's authorization flow. By connecting your Tesla account, you authorize the Service to access and use certain Tesla account, vehicle, trip, and telemetry information as needed to provide the Service.

Your use of Tesla-related features is also subject to Tesla's own terms, conditions, and privacy practices, and you are responsible for complying with all applicable Tesla requirements.

5. Paid Subscriptions

Certain features of the Service may require a paid subscription. Subscription pricing, billing terms, renewal terms, and cancellation options will be presented to you at the time of purchase through the applicable platform, including Apple's App Store where applicable.

• Subscriptions automatically renew until canceled, unless otherwise stated.
• You may manage or cancel subscriptions through your App Store account settings.
• Payments are processed by the platform provider, not directly by Catificial LLC.

Except where required by law or platform rules, fees are non-refundable.

6. Acceptable Use

You agree not to use the Service in violation of any law, regulation, or third-party rights, interfere with or disrupt the Service, attempt unauthorized access, reverse engineer or misuse the Service, or use the Service in a way that could endanger people, property, or vehicles.

You must not use the Service while driving or in any manner that distracts from the safe and lawful operation of a vehicle.

We may suspend or terminate access if we believe you have violated these Terms or created risk for us, other users, or third parties.

7. Vehicle Commands and Safety

The Service may allow you to send supported commands to your vehicle, including navigation-related commands. You are solely responsible for how you use those features.

You acknowledge that vehicle commands may fail, be delayed, or behave unexpectedly, vehicle status information may not always be current, and you must comply with all safety rules, driving laws, and Tesla requirements.

The Service is provided as a convenience tool and not as a safety-critical system.

You are solely responsible for complying with all applicable traffic laws and regulations.

8. Data and Deletion

You may request deletion of your account through the Service's delete account function. When you delete your account, your user data will be deleted from our systems, subject to limited retention where required for legal, security, fraud-prevention, or operational reasons.

Trip data is retained on our servers for approximately one week and old trip data is deleted on a weekly basis.

9. Intellectual Property

The Service, including its software, design, text, graphics, branding, and other content, is owned by or licensed to Catificial LLC and protected by applicable intellectual property laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, lawful use.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, secure, accurate, or error-free, or that vehicle data, telemetry, or commands will always be available or function as expected.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CATIFICIAL LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, PROFITS, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF CATIFICIAL LLC FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) USD $100.

12. Indemnification

You agree to defend, indemnify, and hold harmless Catificial LLC and its affiliates, officers, members, employees, and agents from and against claims, liabilities, damages, losses, and expenses arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party rights.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you violated these Terms, created risk, or if continuing to provide the Service is no longer commercially or technically feasible.

You may stop using the Service at any time and may delete your account through the Service.

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of laws principles, except where applicable law requires otherwise.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms and update the Effective Date above. Your continued use of the Service after the updated Terms become effective means you accept the revised Terms.

16. Arbitration and Class Action Waiver

To the fullest extent permitted by law, you and Catificial LLC agree to resolve disputes arising out of or relating to these Terms or the Service through binding individual arbitration rather than in court, except for matters that may be brought in small claims court or where injunctive relief is appropriate.

You and Catificial LLC each waive any right to a jury trial and any right to participate in a class action, class arbitration, or representative proceeding.
